A MAN who ran from gardaí after trying to steal from a shop has been spared a criminal record.
Dylan Carey (20) was "very drunk" at the time of the incident in a city centre convenience store, a court heard.
Judge Michael Walsh applied the Probation of Offenders Act after he pleaded guilty to charges arising from the incident.
Carey, of Thornberry Square, Clonee, Dublin 15, admitted attempted theft and garda obstruction.
Dublin District Court heard the accused went to Spar on Dame Street last July 5 and got into a row with staff before attempting to take €10 worth of goods.
Leniency
He failed to take them and ran from the garda who arrived on the scene, Sergeant Gail Smith said.
Carey was extremely drunk at the time and was very sorry for his actions, his solicitor told the court.
He had no previous convictions of any kind and had not come to the attention of the gardaí since the incident.
An uncle who the accused was very close to had died and it had affected him greatly, his solicitor said, asking the judge for leniency.
Carey was "deeply apologetic", the solicitor added.
