A FATHER-of-two refused to wear a face mask in a fast-food restaurant and shouted abuse at staff in a "nasty" case of public disorder, a court has heard.

It took four gardaí to restrain Stephen Farrell (35) as he resisted arrest in the incident.

Judge John Brennan gave him a three-month suspended sentence and fined him €400.

Farrell, a mechanical engineer of Cianlea, Swords, pleaded guilty to threatening, abusive and insulting behaviour and garda obstruction.

Dublin District Court heard the accused refused to wear a face mask at Supermac's, Westmoreland Street, Dublin, last May 16 and became abusive to staff.

Outside, he became abusive to gardaí and members of the public. He had to be physically restrained by four gardaí.

Farrell had previous public order convictions.

He was extremely drunk on the night but was co-operative when he sobered up and was a "different person" back in the garda station, solicitor Sandra Frayne said.

Farrell was a separated father-of-two and had a long-standing alcohol problem, the court heard.

The accused was not working at the moment because of a broken ankle, but had a very good work history, Ms Frayne said.

"It was a nasty enough incident at the height of the pandemic," the judge said.

It was not mitigating that the accused had drink issues and his "saving grace" was his work history, Judge Brennan added.

He suspended the sentence for one year.
