A father-of-two who urinated in a garda van when arrested after refusing to wear a face mask in a shop had gone "off the rails", a court heard.

Kieran Sargent (47) was "mortified" over his behaviour on a night when things went "out of control". Judge Michael Walsh told him he could avoid a three-month sentence if he is found suitable for 150 hours of community service.

Sargent, with an address at Árd Mor Court, Tallaght, admitted threatening, abusive and insulting behaviour, failing to follow garda directions and criminal damage.

Dublin District Court heard the accused went into a shop at Aston Quay without a face mask on May 29.

He was intoxicated and when asked to wear a mask, he refused.

Gardaí directed him to leave before arresting him. While he was in a garda van, he urinated and it had to be professionally cleaned.

The court heard he had previous public order convictions.

"He seems to have antipathy towards members of the gardaí," Judge Walsh said.

Sargent did not have any problem with gardaí, his solicitor said.

He had always "struggled a bit" with alcohol but after he split from his long-term partner, he lost his home and went "off the rails."

"It seems things got out of control on the night, he didn't mean anything by it," the solicitor said.

"He was completely mortified and apologetic."

Judge Walsh adjourned the case for a community service suitability report.
