Kelly Rutherford loses three year custody battle

Actress Kelly Rutherford has been left devastated after a judge ruled her two children should remain in Monaco with their father on a permanent basis.

The former Gossip Girl star has been locked in a bitter custody battle with her ex-husband, Daniel Giersch, for three years, after a judge ruled the couple's 50/50 parenting agreement should remain in place, despite the fact Daniel was unable to return to the United States after his visa was revoked in 2012.

Their kids, Hermes, nine and Helena, six, were sent to live with their father in Monaco, and Kelly has been fighting for their return to America ever since, but on Tuesday (15Dec15) her worst nightmare was confirmed when a Monaco judge granted full custody to German born Daniel, 41.

The court ordered the former couple to make decisions together regarding the children's schooling, health and religious education, but Kelly, 47, is only allowed to "exercise her visiting and accommodation rights exclusively in France and Monaco," Britain's Mail Online reports.

The actress will get to spend half of Christmas, spring and summer vacations with her offspring and she will receive a total of 3000 euros ($3,281)- a-month in maintenance.

The two children last spent time with their mother in America over the summer, and Kelly had to forced by court authorities to hand them back to their paternal grandmother after she refused to send them back to Monaco in August (15).

Kelly and Daniel tied the knot in August, 2006 but the actress filed for divorce in December, 2008, months before she gave birth to Helena.

The financial cost of the legal battle has also taken its toll on Kelly, who filed for bankruptcy in June 2013.

Reports suggest Kelly has filed an appeal. She has declined to comment on the latest court ruling.
