A man who had unprotected sex with a woman without her knowledge has been given a 12-month suspended sentence in a court in Switzerland.

Swiss News Agency RTS reports that the couple met on Tinder and the incident occurred on their second date. They began to have sex but the man removed the condom without the woman's knowledge.

After the woman found out she reported him to the police.

The Frenchman was arrested and appeared in court in Lausanne this week charged with rape.

The woman said she would have refused to have sex without a condom.

The judge in the case ruled that sex without a condom when a condom was expected to be used was rape.

The man was handed a 12-month suspended sentence, which he plans to appeal.
